  • CCJ from 2019 - advice please

    I have an issue which I haven’t come across when researching in the threads.

    I received a CCJ in December 2019 for a parking fine. The claimant is a private individual, not a company or similar. I noticed this on my credit rating in 2020, naively buried my head in the sand as an immature early twenty going through some pretty awful personal circumstances. I did notice at the time that the address the judgement was sent to was incorrect? I’d moved from that address 6 months prior. I just assumed it would go away eventually and did nothing (I know…hindsight is a wonderful thing).

    Fast forward to now. I know this will “fall off” my credit file late next year but I am ready to face up to responsibilities. The existence of the CCJ is now impacting my career and I want to buy a house early next year. My issue is I can’t get the claimant to respond to me. I have tried emailing the details given to me by the court as well as sending a letter recorded delivery to the address. He has collected it (it is a PO Box) but not made contact. I don’t know where else to go?

    is it worth applying to have it set aside, even after all this time? It was served incorrectly and I didn’t receive any correspondence. I can prove my personal circumstances at the time if they will take that into account. But I’m aware it’s been 4 years. How can I get around this if he won’t communicate with me?

    you apply to set aside. if he ignores hte court lettes it will likely be set aside by default in absence of him turning up.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
