  • Company paid a CCJ three months late

    Having litigated against a company they were ordered to make payment within 28 days of £2,500.

    I contacted them and sent my bank details.

    They said they had to wait for the court order before making the payment. I reminded them that the date due was stated by the Judge at the trial.

    They ignored me. I emailed and told them this money is being used for A B and C and this included a holiday. I had paid for flights. I asked them to make payment immediately or I could not go.

    They ignored me.

    So those flights were not used.

    Can I claim for the flights from the company?

    Payment was made three months late.

      Interest is only chargeable on judgement debts over £5,000; claim for flights no.

        atticus so a debtor can pay whenever they feel like and there is no comeback?

        I read somewhere that the company cannot claim the flight costs were unknown to them and were outside their consideration because I told them the repercussions of the late payment?

            Yes. But that would have taken at least a month. When the due date came and went I let this company know the flight departure date was two weeks away, and yet they did nothing to effect payment.

              The flight situation raises all kinds of questions. Why could you not go on holiday? Were you unwise enough to book and pay for a holiday you could not otherwise afford in the expectation of being paid this debt?

                I earmarked the spending money for the trip elsewhere once I knew I had the money coming on such and such a date from this company. Was booked long before the company were ordered to make payment. I had no reason to believe the company would not pay by that date, as they had immediately contacted me after the hearing and requested my bank details "to effect payment"

                    I wouldn't have done this if they had not requested my bank details. Because I was aware they might appeal.

                    I reminded them that the due date for payment was stated at the hearing, and they ignored three emails chasing this up after I reminded them.

                    I'm sure there must be liability there?

                      sorry there is no liability.

                      You should not be booking things you cant pay for expecting a company to pay a CCJ on time.

                      The money is only in your account when its in your account.
