    Hi Sorry to jump on this post, i am in exactly the same boat and to be honest want to try and settle before going to court, do I put without prejudice or without prejudice save as to costs when trying to ask for a lower figure? Can i email also? Thanks and sorry if this is not allowed

        I’ve received a directions questionnaire from the sols but not one from the court. I’ve had no communication regarding a directions questionnaire from the court. Is there a deadline as such?

          You really need to chase them on it, but in saying that the form is available online.
          Send a copy to the Court and a copy to their solicitors. Make sure you get Proof of Postage.

          If you get stuck, ask.

          You want Mediation providing you received all the requested documents.
          You want a Hearing in person so that you are available to respond to any question the Court may have.

            NO this is a scare tactic from the solicitors, you wait for the court not the solicitors.

              How should I write the CPR request to the solicitors because they did not put much in the particulars of claim?

                Ask them for all documents stated in their claim against you.

                  Claimant claims payment of an overdue balance in the sum of 9500.00 incurred by the Defendant under a Oplo, Unsecured Loan, account number #. The Defendant failed to maintain payments in line with the Agreement and the account has now matured.

                  The account was then subsequently assigned to the Claimant and the Defendant has been given notice of the accounts assignment.


                  I need to ask for
                  The alleged agreement
                  The alleged Assignment

                  Is this all because that is all this has mentioned in the particulars?

                        See it as an opportunity to resolve the matter, but don't commit to something if you aren't happy.
                        Mediation is separate from the Courts. The Court won't know what has been discussed.

                          Mediation failed. This is my defence a lawyer gave a free 30 minutes suggested it misses some points and needs amending. Could anyone help?
