    Hi I was sent a high court enforcement letter informing me of a judgment set against my name on 7/8/23 but I was never informed by my solicitor or the high court or the defended it only came to my attention when the high court enforcement wrote to me on 3/10/23 then I rang around and got my solicitors to pay that judgment but this year I had filed to have the CCJ set a side to the Leeds combined courts and the judge wrote to the defended solicitors if they wanted to object and they told me to withdraw my case as the payment was paid to them and they have closed the case and if I don't withdraw the case and go to the hearing in October this year they will charge me for the bundle they have to get ready for the judge and arrange telephone conference call as I was going to represent my self but when i rang the other side solicitors to find out how much there bill could come to and it was in thousands so i withdraw my claim to have the ccj set aside I was told by others solicitors I had a strong case but if I lose I could be paying there fees which I can't afford but can I write to other side with consent order where they agree that the original judgment order was not sent to me had it been sent to me it would have been paid within 28 day's my solicitors did pay it when the high court enforcement wrote to me in October and it was payed in 17 days any solicitors on this form please advise me your help is much appreciated or can I not write a consent of order to the other side if they can agree and sign that form and then may be I can send it to credit agency to get the CCJ off my name thank you in advance

      Hi everyone I was sent a high court enforcement letter informing me of a judgment set against my name on 7/8/23 but I was never informed by my solicitor or the high court or the defended on the original judgment that was made against my name on 7/08/23

      it only came to my attention when the high court enforcement wrote to me on 3/10/23 then I rang the high court enforcement agency and they told me of the judgment against my name

      ​I called my solicitors to ask about the judgement against my name and they told me it should not have came to me but instead it should have gone to them so they can pay it which they did do but on 20 October 23 but since it was payed late by my solicitor I have a CCJ in my name now

      This year I have wrote to the courts to have the CCJ to be set aside as I was not informed of the original judgment on 7/8/23 had I been informed I would have made sure my solicitors would have payed it within 28 days

      But now the judge has wrote to the defended solicitors if they wanted to object to me having the CCJ set aside but the other side solicitors have rang me on few time telling me to withdraw my case as the money has been paid and they have closed there file and that I can just apply for a certificate of satisfaction but I have told them I have only applied for the ccj to be removed off my name as I was not informed of the original judgment back in 7/8/23 had i been informed it would have been paid within 28 days

      NOw the judge has set a date for October this year and told the other side solicitors to get e digital bundle ready for the court and arrange a telephone conference call as I don't have a solicitor

      But the other side solicitors are saying they will charge me for the e digital bundle they have to get ready for the judge and arrange telephone conference call as I was going to represent my self but when i rang the other side solicitors to find out how much there bill could come to and they said it can be in thousands of pounds so i withdraw my claim

      I then rang around others solicitors firms to get advice on my case I was told I had a strong case but if I lose I could be paying there fees which can run in to thousands of pounds

      As of this moment I can't afford to pay such fees if I lose so I have withdrawn my case from the court

      but can I write to other side with consent order where they agree that the original judgment order was not sent to me had it been sent to me it would have been paid within 28 day's my solicitors did pay it when the high court enforcement wrote to me in October and it was payed in 17 days by solicitors

      please advise me your help is much appreciated

      ​​​​​​Can I still write a consent order to the other side and explain to them why they got paid late in there previous email they have accepted the payment was paid in the 28 days and then send it to the courts and try that way then may be I can send it to credit agency to get the CCJ off my name thank you in advance

        no you wont be paying their fees to organise a bundle
        if you lopse and your on SCT you wont be paying anyones fees but your own
        you cant withdraw your case your the defendant so not sure what you mean with that
        no you can't write to them to seek consent, you have already appliedl let your appliaction run to october where it will be set aside

          I have already withdrawn the case and the judge has vaccinated the case with no cost to my self
          the other side solicitors we're ringing me and emailing me to withdraw my case or be prepared to pay there fee for preparation for the e digital bundle and a telephone conference call which was going to be for 30 minutes or longer.
          which could be between £3 to £6 thousand pounds that's if I lose and the judge decides not set the CCJ aside .
          I guess i will have to live with a CCJ on my name now for 6 years .
