  • When to submit defence

    Hi - will try and make this short!!!
    My hubby got a parking fine, jist of it is it was a fine via ANPR but he did not park in the hotel car park as was told he could not instead he went to park where the car hire place is (there is a sign saying where to go for the car hire place). This was a Holiday in near Heathrow.
    Anyway decided to defend. Completed a N180 form which was not submitted by the courts so judgement went ahead and issued a CCJ. I have acknowledgement from the courts that my N180 was not submitted and is being referred so is being referred to district judge/legal advisor.
    My questions are:
    When should my defence be submitted
    If I pay the CCJ so its removed from my credit record and my defence is upheld will I be able to claim the money back?

    Q1. Within 28 days of service of the claim form, provided you have filed the acknowledgement of service within 14 days. It's all in the information sent with the claim form.

    Q2. No chance.

      Hi thanks for reply. The deadline for payment was today and I did not want to risk having a CCJ on my record. I was going to send appeal forms in tomorrow as the courts sent them to me when I advised about my N180 not being submitted. So you definitely think I would not get my money back from DCB Legal if I won and CCJ was withdrawn.
      We did not park in the Holiday Inn carpark as we were told we could not as the hotel was for immigrants only. We were taking my nephew to collect a car from the car hire place behind the hotel. There is a sign that directs you to the car hire place. So the fine was via ANPR so no actual proof of us parking in their carpark. It was the Holiday Inn near Heathrow.

        You can apply to set the judgement aside...

        dont pay anything to DCB legal just apply for set aside.
