    Hi

    I owed some money to a private health business and received a county claim for it

    The claim was wrong and I wrote to them and asked them to check their records - no reply was received before defence had to be submitted so I defended the whole claim

    Mediation was not an option because the debt was disputed

    Now, a court date has been set for 13/09

    I have to get witness statement done by 16.08

    I wrote to them again last week and they have now acknowledged that 2 of the invoices had been paid

    I can settle some but not all of the debt before 16/08

    Do I get breathing space in place to give me more time?

    What should I do?

    Hello,

    Are you disputing the debt because you don't owe all of it?

    You say you can settle some but not all of the debt, are you admitting some of it is owed? If so can you settle the amount you owe?

      I disputed the claim because it was not completely correct

      I can now settle but would rather not pay it all now as I wouldn't have any surplus cash left

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
