    Have recently received a Civil National Business Centre claim form, when trying to access the account online it came up as an invalid case number, so contacted MCO. In the meantime we have noticed that the Claim Form does not have the court seal on it.

    We have now been advised that the claim number is valid, how does that affect the timing issue as the claim was issued 19th June 2024 posted to an unattended address (which the claimant had been expressly requested not to use). The court has informed us we may send the acknowledgement via email which will give us 14 days from the date of issue (12 days already lost.
    Also no letter before claim has been sent.
    Also how do we get the matter transferred to our local court rather than Online.

    Any advice please

    Hi,

    You should fill in a AOS from the gov website and send that ASAP

    Bring up the address issue in the defence.

    LOC are not really required, and just a procedural thing (yes you should send one but if you dont hte claim will still go ahead)

    It will be transferedd by default, it is only shown as online because its a robotic court that issues the claim forms

          Very unlikely there will be a sample defence that completely suits your case
          Take a look at "Example Defence" under "SHORTCUTS" on the righthand side of this page.
          You should be able to adapt it to suit your defence
          Paragraphs 1, 2, 15 and 18 are pretty standard
          Paragraphs 14, 16 and 17 may apply if the claimant has failed to send documents that you have asked for
          The numbering of your paragraphs in the defence should correspond with the numbered paragraphs in the claim
          End with the signed Statement of Truth

              Pezza54 hi attached is the claim, we are contesting the whole of it, When CNG and went bust we were paying £142 per month for gas, Pozitive energy were given the contract under OFGEM scheme, we were with them for 6days before changing to British gas. Could you advise how to word defence

                  CNG would have passed the outstanding debit (amount owed) to Pozitive Energy when PE was appointed your new supplier.
                  PE would not have allowed you to transfer to BG with money owing
                  There could be errors in CNG's bills. Are you able to post a few of CNG's latest bills and any letters you received from PE

                      Did you provide BG with a meter reading when you transferred? Are you able to post BG's first bill?

                          Please see flint Bishop letters, Please note first contact with either Flint Bishop/Pozitive Energy was 1st November 2023.

                          Have seen that there is an invoice from CNG administrators and PE, both for November 2021

                          We have paid all known invoices except this £7K demand, prior to dissolution of limited company due to retirement, This has now been suspended due to this case

                            In post 7 you stated you were only with PE for 6 days. One of PE's invoices covers the period 7.11.21 to 6.12.21 a period of 29 days Then until 12.12.21 another 6 days making a total of 35 days
                            PE invoice has an actual meter reading of 78201 and a later PE invoice has an actual meter reading of 82848.
                            Are you able to confirm these readings were taken from the meter and are correct?
                            My post 11 asked if you provided a meter reading to BG
                            If you did was it 82848?

                            PE's calculations for converting units used into KWh are correct
                            With CNG you were paying just over 4p per KWh. PE charged you 11.4 p per KWh, nearly 3 times the price

                            If the meter reading of 82848 was correct, then PE's price for gas used is right
