  • HELP! With CCJ Court Letter

    Hi,

    currently going through the process of getting ccjs removed/set aside. They were for 2 parking tickets that I knew nothing about as the creditor sent all information to the wrong address. Anyway the creditor has signed a consent form and agreed they didn’t try hard enough to didn’t my current address with all the evidence my solicitor sent over. Below is what I received from the courts a few days ago but I’m struggling to understand it, can anyone help explain ? TIA

    UPON READING the Minute of Order filed herein, a copy of which is annexed hereto

    WITHOUT HEARING AND BY CONSENT

    IT IS ORDERED THAT: -

    An order is hereby granted in the terms of the said annexed Minute and that it do stand as the order of this Court

    Note: This order has been made without a hearing under the Court's case management powers contained in the Civil Procedure rules Part 3. You may within 7 days of the service of this order, apply to the Court to set aside or to vary the order under Part 23 Rule 10. You must file with the Court, and serve on the other parties, an application that sets out your reasons for objection. A fee is payable upon the filing of the application. When your objection is received the matter will be listed for hearing unless you ask the Court to vary the order without a hearing.

    Welcome to LB
    Do you know what "said annexed Minute" states?
    Whatever is says, the court has approved it.
    As the claimant consented, they are unlikely to apply to have it set aside.

      a copy of which is annexed herto

      means that whatever is annexed is approved.

      look at whats in the applicaiton, it means that is approved.

        Thanks for getting back to me after getting a new credit report today, both CCJs have been removed already. Thanks once again
