  • Small Claim - Defendants Name amendment

    Hi there, I have started a small claims. In the Defendants Name, I had to enter 'ABC Plc - Law Firm' as it was going via post to their law firm and there is no 'care of' field on the online form. The defendant has written in their Statement of Defence that the Legal entity of 'ABC Plc - Law Firm' is not recognised.
    It is quite obvious what I meant, and they have given a full statement to all my claims.
    Will I need to amend the Defendant name to 'ABC Plc' to be able to take it to a hearing?
    If so, how can I do that please?
    Trying to do this by myself as I cant afford a solicitor, but they have corp lawers on their side :-(

    Please clarify - Is ABC Plc not a law firm?

    You can apply to amend the name of the defendant under CPR 19. Use application notice N244 - https://www.gov.uk/government/public...ication-notice

      Thats correct, I entered the company name, dash, law firms name, who are acting on their behalf
      .
      Sounds daft but the online form only asked for the Name and Address, and it was being posted to the Law Firm so I didnt have another option.

      Would I officially need to amend the name if I wanted to proceed with the Hearing?

        It is easy enough to find a company's registered office.

        You would be wise to amend the name, as the point has been taken.
