    Just found out via my credit score i have got a ccj since 2019 I’m not disputing the fact I owe the money but I’ve had no contact from the courts ie demanding money or can’t even remember setting up a payment plan my question is I want to pay this ccj will Cabot take back the debt ? I’m unemployed and I have an appointee who looks after my day to day things as I suffer from mental health. I don’t want to attend court so do I contact Cabot or the court to start up payment plan it won’t be any large amount and gutted that 4 years have passed as I would have probably paid the debt of any advice would be good thank you

    If you didn't receive the Court papers you can get the CCJ set aside (you maybe able to get help with Court fees because of your circumstances).

    The first thing to do is get consent from Cabot, explain the reasons why you are seeking the set a side, didn't receive Court papers, health etc. If they consent, then you can make an arrangement to pay an affordable amount each month. Fill in an income and expenditure form, take into account the cost of living energy, food etc. If you are left with £5 each month to pay them then so be it.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
