  • Piggy Bank and TM Legal - CCJ Set Asside

    I had an unaffordable payday loan from Piggy Bank in 2018. As you may know PiggyBank were closed down by the FCA due to concerns around unaffordable lending.

    TM Legal took the debt over and issued a CCJ in 2021.
    The debt now totals £1600 and I am in a position to pay but I would like the CCJ Set Asside/removed as I do believe I should not have been allowed to take out the loan on the first place.

    What are my options here do I have any grounds?

    Unless you can prove that the CCJ was invalid due to procedural grounds i.e. TM Legal made a mistake in the procedural process (a common issue is the claim form being sent to the wrong address and the claimant failing to ascertain the current residence), you have next to no chance of getting it set aside as you are way out of time.
