  • Parking Notice from a very dodgy 'firm'

    Received a parking (not Penalty) Notice in my car park at home. They dragged their feet issuing me a new one. They ticketed me twice. But I kept my old permit on display until they would issue a new one. I went through the tribunal process, they told me to go back to our beloved PCM / Gl*dstones. I did and fought back, they disappeared. And now, a year later after hearing absolutely nothing from ay of them. They issue a Court Claim for about £460. Any advice before I respond to the claim would be useful. Also, would it be worth counterclaiming for my time and expenses. I've been fighting these cowboys for a year! Thank you.

      what is the date of issue of the court claim?

      we are going to need sight of the signs.

      what permits did you have ?
      who issued them?
      why were they necessary/
      are these parking spaces to do with where you live e.g. attached to a flat

      in other words please tell us the whole story from the beginning

        Issued 21 Nov. I called them and they have given more time. I need to reply before the 27th Dec.

        Resident Parking Permit issued by PCM. They manage the residents car park.

        PCM

        Because people who do not live in the building, keep park in our private car park

        Yes. In my case, I emailed PCM, requesting to renew my permit, one week before my old permit expired). I emailed them as I noticed my neighbours had new permits and I had not. PCM dragged their feet, but eventually sent me a link, to apply. This included, uploading car insurance docs.
        It was in fact myself and other residents who agitated, to reintroduce, the issuance of parking permits, only to residents with cars registered to the address.

        All done, and PCM said my new permit was in the post. In the meantime I kept displaying the old permit, with a note in the windscreen saying, please do not ticket. I'm waiting for my new permit to arrive (I have images /evidence of this). But PCM ticketed me twice within a period of a few days. In the car park of my own home. These are the two tickets I am now challenging through the courts. This all happened Jan 2022.

        So, I went through their IAS appeals process. And they told me to go back to PCM. PCM referred it all to Gladstones. So I wrote to the MD at Gladstone's (recorded delivery) to investigate it and he/they ignored me too.

        Then a few months later. Someone (I'm assuming from inside the corrupt PCM office) posted correspondence to me, containing copies of emails, between, myself, the building manager and PCM. Strangely, attached to the emails, was also a colour image of my car (but before I owned it!). The image showed a PCM notice in a small yellow bag on the windscreen. And inside the car, a residents parking permit was visible. In addition, inside the correspondence was an A4 photocopy of a Parking Charge Notice. With the date of issue on this notice being almost a year before I owned the car.

        I had purchased this car, through a car dealership and a quick check with the DVSA would have confirmed I was not the owner/registered keeper of this car at the time, this particular PCN was issued. So why would PCM (assuming it was PCM - as who else would have information on that ticket) send this to me? Oddly they were not claiming for this ticket. They just attached an A4 copy of it to copies of my personal emails. And sent it to me.

        I wrote to PCM asking why were they attaching information, about a car (not registered to me). To transcripts of my private correspondence between themselves, myself and my landlord. And posting this information to me? PCM did not answer. In fact I did not hear from PCM, Gladstones again, until Nov 2023.

        I have been fighting these two ridiculous PCM notices, for almost two years now.

        I have not responded to the court claim yet. And still have a few more days to reply. I of course have copies of letters, images, emails and documents to support my claim.

        Do you think it's worth making a counter claim for my time and expenses? if so, how much is a reasonable figure to charge?

          Did you follow the instructions that came with the claim form i.e. did you acknowledge receipt of the claim form within two weeks of receipt or was this a private arrangement with the parking company

          Do you own your property, or is it leasehold?
          Does it include the right to park?
          Does the lease say anything about your parking rights being subject to displaying a permit?

            NA

            Yes I acknowledged the claim online within two weeks. I called them to double check and went online to request more time.
            I just have to submit my defence online now, by the 27th Dec 2023.

            I'm renting. The agreement does not mention parking. It's all administered by PCM in Slough.

              At one time parking permits were not required.
              So who has the right to park in that car park?
              Where does that right come from?

              What I am driving at is that your right to park there does not depend on displaying a permit from PCM, but probably derives from your landlords right to park there as the owner of your flat.
              You may need to contact your landlord
