  • PHSO ombudsman - refusing complaints.

    Hello,

PHSO informed me that since Covid, their criteria has changed, eg they wont accept complaints about complaint handling, even when laws were broken by staff.
Does anyone know what legal basis the PHSO have in throwing out the complains? Can they be challenged? The phso case worker didn't even inform me about a judicial review which I believe I am entitled to; every question I asked him/her was ignored! I had better not say too much on a public forum. I feel like complaining but suspect the case worker (clerk) will exercise their 'power' again and....

How I can use my MP as support - any past experience on the forum? I have tried at least 15 solicitors for help and no offers, no one wants the work

    NB
A stage 2 [appeal] complaint is the PHSO. I was turned down bc I was told I had not proved I had gone through enough pain. Has anyone else had this issue?

    New Complaint Just made:
As you may expect, there was not a single concession from the dr surgery in replying to my new complaint: the slandering of a patient, data protection fails, unprofessional behavior, breaking NICE, guidelines to start. Over one years wait to get an answer & no apology; the response letter is so vacuous. distorted, to cover their own backs, it's embarrassing, even though I used hard written evidence to support my case.

I would appreciate any advice; its like a lone weakling up against a pack of bullies

I don't know if the following helps, unfortunately Ombudsman can be 'hit and miss', always looking for easy options -

I don't trust them to be neutral. Have you taken a case to court, made a civil claim without a solicitor before? How can you judge how much to claim for?
