  • Application to set aside - new evidence?

    I applied to have a County Court order set aside. That application was dismissed without a hearing, but I was given liberty to apply to have that second order set aside. I have submitted that application, and a further hearing has been arranged to hear the application. After my first application was dismissed, new evidence emerged which supports my case. My simple question is, am I allowed to adduce this new evidence in the upcoming hearing, or will the court insist that evidence is limited to only that which I adduced way back when making the first application? Help appreciated.

      I have submitted the new evidence, but the other side is arguing that it should be ruled inadmissible as it was not adduced first time around. Not sure if they are right.
