    I need legal advice with help in trying to get justice. A brief summary: I had a telephone hearing during lockdown as the claimant in the Small Claims Court. Unbeknownst to me the judge never had my paperwork, exhibits, witness statement, etc, & I was only informed during the hearing whereby he continued only with the defendant's evidence. He found in favour of them & refused to allow an appeal; it seemed very biased from the start. I went though the court's procedures to get an appeal & that's where mistakes were made by the court: filing appeal late, not logging emails, other judges not being given evidence that I filed on time. I have been told that I can take action against the court but finding it hard to find a solicitor to take on my case. Any suggestions or anyone know of anyone who can take on my case?

    The cost of employing a solicitor to prosecute such a claim will outweigh any benefit.

      Have you complained ton the courts https://www.gov.uk/government/organi...ints-procedure

      If you are dissatisfied with the outcome you can escalate your complaint via your MP to the Parliamentary and Health Service ombudsman https://www.ombudsman.org.uk/making-...nt-help/courts

        Thank you for the replies.

        The complaint system doesn't take into account how the judge behaved & his failings in not having all of the evidence to make an accurate judgement.

          In your earlier post you said it was the court's fault the judge did not have all the evidence:

          How do you think that it was the judge's fault that he did not have all the evidence? He can only work on the papers he receives.

            It was odd as the judge had received everything else & I stated clearly in an email that I had attached supporting evidence to show I filed on time. It also looks like "selective reading" on behalf of the judge...

                I filed on time the court's administration filed late, I don't get an appeal when it can be shown I filed on time. It's no longer about getting an appeal - It's serious neglect on the part of the court, its judges not looking at my case and/or asking for more information. If my evidence would have been seen there would have been a different outcome - the hearing judge basically just decided he knew everything - when he knew nothing!!

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
