  • Claiming against an overseas defendant - legislation permitting this

    I'm pretty certain there was a thread in the last month or so where this question arose and one of the more knowledgable posters referenced some legislation which enabled this and also enabled enforcement of any judgment.

    Can anybody refer me to this - or am I simply making it up?

    It is not a question of legislation. It is a question whether the English court has jurisdiction, and after that of obtaining permission to serve proceedings out of the jurisdiction.

      Enforcement is under one of the various treaties and conventions depending on where the defendant is.

      But none of what I have said applies if your defendant is in one of a few countries, including the USA.
