  • Is a debt ever statute barred after Court action?

    I have tried to search for an answer on whether a debt can ever be statute barred after the claimant has taken it to Court, but only seem to find threads where a CCJ was awarded. What happens if the applied to court, I defended and they were never able to provide paperwork? Can they try to resurrect things forever after that?

    Basically, I defended, asked them for proofs over a year ago and it has all been quiet. Then out of no where, I get a letter threatening I may get a CCJ if I don’t pay them. The debt was a almost statute barred last year when they took it to court, but do they ever lose the right to pursue that again, now they have taken it to court? I’m hoping they haven’t now found paperwork but it seems unfair if they can’t find it in a reasonable timescale, to have that threat hanging over you forever, once they’ve got the initial court papers in.

    The case is likely to have been stayed by the court. The claimant will have to apply to lift the stay.
