  • Failure to verify Statement of Truth in Particulars of Claim

    Hi.

    I'm the defendant in a case which I lost but have appealed.

    The claim was issued against me a year after the 6 April 2020 rule changes where the Statement of Truth had to be dated - the claimant failed to do this.

    I've read that if not verified the Particulars of Claim remain effective "but a party may not rely on the contents of a statement of case as evidence until it has been verified by a statement of truth".

    What does this mean exactly? The claimant in my case was clearly able to rely on their Particulars of Claim as evidence even though it was not properly verified.
