    Hi
    I have received an application to strike out my claim or seek summary judgement. My question is should I submit an application to amend my particulars or wait for the hearing of this application ?. I don't want to risk having to pay their costs of the application and pay mine. I don't think they would be successful but I could amend my particulars slightly to cover more points. I have opposed the application and send a witness statement to Def sols.

    The case is against a contract. Tort conspiracy, Misfeance, misrepresentation and breach of contract. KBD..

    If you think there is a defect in your Particulars of Claim that can be cured by amendment, I suggest that you get on with it.

      Ok thanks I really appreciate the reply. I have it ready to go.

      When making the application should it be on notice ?. When it says 3 clear days does that mean I serve the Defendant and then wait 3 days to file it and pay the application or file/pay and date 3 days from tomorrow ?.
