  • Money Claim - Response filed online and by paper N9B

    Hi all,

I received money claim from neighbour due to a flat leak. Claim was defended and admitted in part (but not all) of the claim. A counterclaim also filed by paper - N9B form, with the fee, also paid for. Given the online portal was also requesting a response, the particulars online were filed too with the defence stating "refer to N9B and claim particulars". Essentially the defence was filed online and by paper, and a counterclaim on paper (as you cannot do a counterclaim online)

Today, money claim staff have deemed the paper forms invalid and returned this to me in favour of the Defence filed online (which did not even state a defence). They advise N244 form to seek permission to reinstate this?

Does anybody have any advice regarding this? Clearly not familiar with this process at all

    see CPR 20.4: https://www.justice.gov.uk/courts/pr...l/rules/part20

Why not do it the old fashioned way with a defence and counterclaim on paper, sent by post, and by email?

Thanks for message, I did do the defence and counterclaim by paper and sent that through. However, the issue is I also filed a defence on the money claim online portal and the clerical staff have deemed the paper form invalid. In other words, you cannot file a defence online by the portal and by paper?
