    I posted a while ago about whether I would have grounds to get a CCJ set aside, due to TM Legal not sending letters to my correct address.

    i complained to them and they have emailed back nearly 7 weeks later stating that they won’t uphold my complaint.

    I will attach a copy of the letter they have sent me.

    What’s the next steps does anyone know? Can I apply to set aside myself? Can I go anywhere else to complain at t this point?

    I believe that in their letter there are some discrepancies, they stated on the 21st July 2022, when I first made telephone contact, that they had not made a claim against me, so their advisor on the phone wouldn’t have told me that the claim would be removed but then stated that the county claim and letter of claim had already been issued prior to that phone call on the 21st July. Although, I’m not sure if they are talking about two different things.

    I have requested a copy of the phone calls I made as I believe that the advisor said that the claim would be removed during the phone call on the 21st, because I’d not received the CCA I’d requested a year prior to this. In which case the whole process should have started again.

    they have also stated they sent a copy of the CCA after this phone call, in August via email but strangely, that’s the one email I didn’t receive and I’ve not deleted any of their email correspondence.

    I really can’t afford to pay the £275 fee just now and don’t want to if there’s no chance of me getting the CCJ set aside but I don’t know what to do.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
