Which court has jurisdiction

Claimant lives in Scotland
Defendant lives in England
Sale of item from defendant took place in England
Should the claimant issue the claim using the English Courts or must they use the Scottish Courts (or are they free to chose)

If it were the other way round, a claim could be issued in the English courts for service in Scotland. But you would need to check whether the reverse applies. This would be a matter for someone with knowledge and experience of the Scottish courts.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
