    Morning
    Can anyone please tell me how to seek compensation directly from police for a data breach? The no win, no fee crowd aren’t interested, as not enough in it for them.

    briefly: son was arrested, cop established his occupation, cop went home and told their partner all about it, because partner worked at same place, partner immediately sends messages over WhatsApp to numerous people in workplace, with untrue and damaging content, police investigation found that officer did breach data and they are to be disciplined.

    how would he know how much compensation to seek? Is there a fixed scale?

    any help appreciated. Thanks

    There is no fixed scale.

    Compensation is according to loss. What losses have been suffered?

      the losses are difficult to quantify. His promotion prospects are undoubtedly negatively affected and his mental health and reputation was certainly impacted. Colleagues he had a decent relationship with ostracised him and people openly repeated wholly inaccurate versions of the incident

        dslippy do you have access to any of the cases? I remember there was one a few years ago that attempted some guidance.

        There may be a claim here against the police force.

              Arrest was legitimate, inasmuch as the threshold of suspicion is very low. He was arrested for three things. Cps withdrew two at court, acknowledging that charges shouldn’t have been laid and the third matter was charged as obstruction, when he was arrested for assault. The cop informed her partner that, essentially, she’d been beaten up. It wasn’t charged because, by cops own evidence, it didn’t happen. She didn’t have a mark on her, despite telling her husband she’d been punched in the face by a 6”5, 18 stone, ex boxer

                      Hi, this looks like a clear cut breach. And they have even admitted to breaching the data.

                      Compensation on a data breach is paid based on the harm you have suffered as a result. This could be severe distress and embarrassment. I would say if he has suffered from stress and even been unable to work because of a hostile work environment then a good solicitor would be able to fight your case.
