    Hi - I am currently going through a small claim against our landscaper for the issues we have with our garden after he completed the works and refused to come back. We had our first hearing via BT meet me and the judge ordered an independent survey which has just been completed and found in our favour that the whole garden needs to be ripped up and redone to IBP.

    my main concern is this is a major cost of around £9500 that we are going for including the fees etc. We think he may declare himself bankrupt to avoid paying anything - could he do that or would he still be liable?

    he also has now turned his business into a Ltd company since we started court action so he is being sued as a sole trader.

    any advice on this would be great and thanks in advance

    Defendant's ability to pay is always a risk. Yes, he could go for bankruptcy, although that would have significant personal consequences.
