  • HELP NEEDED - Lowell/Overdales Solicitor Court Claim

    Hi everyone... I could really do with some help.
    I received a Letter before Action from Overdales Solicitors on 28 February for a total of £2101.89 (New Day Ltd, JD Williams and Sky). I have checked my credit file and the first two are almost statute barred under the 6 year rule.

    With regard to the JD Williams Debt, I made an affordability complaint to JD Williams last year which they did not uphold and it is therefore now with the Financial Ombudsman for adjudication. I have phoned Sky and they have said I don't owe anything.

    The thing is that I have spent the last five years desperately working on my credit file in order to turn my life around. The last thing I need now is a CCJ.

    As soon as I received the Letter Before Action I wrote to Overdales with a CCA request and they replied on 8 March saying they did not have the information I had asked for but they will send it to me once they had received the same from their client (Lowells). They also said they did not have to provide copies of anything for the Sky debt as it is not regulated by the Consumer Credit Act 1974.

    I have now had a County Court Claim form and just not sure of the way forward.

    Dont the solicitors have a timescale to produce the documents? What do I write on the claim form? I could really do with some advice as the way forward. I did see on another thread that there is a CPR letter that could be sent to the solicitors?

    Sorry for the long post.... just panicking now. Any help would be gratefully received.
