  • Charging Order by MSF Portfolio/ Restons/ Cabot

    Back in 2016 Restons obtained a charging order on a house I own after obtaining a CCJ on behalf of a credit card company.

    They only got the CCJ because they sent the court papers to the house itself that I wasn't living at and the tennant who was living there failed to forward them to me. Although I do take responsibility for that - having not been to collect any mail from that house for a long time. Funnily enough, Restons managed to find my correct address to inform me of their charging order obtained!

    The debt related to an aged credit card debt which I disputed and would have fought if it went to court.

    Anyway, fast forward 4 years and in october 2021 I start getting letters from Restons about paying the charging order. I consider it as I am now in a good financial position and want the charge taken off my property title. I call Restons and offer a full and final settlement of a reduced value of the debt - they say they will put it to their client to consider.

    In the meantime I am looking at moving house and am talking to a mortgage advisor. He advises to wait until after December 2021 as the CCJ will then be dropped from my credit file and so lenders wont be able to see it.

    Restons then call me back and say my offer of a full and final settlement has been accepted. However, I now have a load of other stuff on my plate and moving house etc has to be sidelined so I dont follow through with it.

    Just under 4 months later I get a letter from Cabot financial saying "we would like to apologise" - "we recently identified that we incorrectly obtained a CCJ and charging order against you".. "we have asked our solictors to ask the land registry to remove the debt..." etc

    Extremely concerned that another charging order had got on the property without my chance to defend myself, I check the current title deeds.. There is still only 1 charging order on there from MSF Portfolio.

    So, now I am extremely confused. Has Cabot financial contacted me by mistake about another CCJ that doesnt actually exist?

    Or, is Cabot Financial the same people as Restons and MSF Portfolio and they are talking about removing the actual charging order from 2016 ?

    I am concerned about contacting Cabot in case its some kind of scam or other underhand attempt at some action against me....

    Any opinions greatly appreciated!
