  • Help with dq

I am the Claimant in proceedings. The Defendant has lodged her DQ and stated she is unavailable for 8 months. Is this allowed under CPR guidelines? Is this acceptable? Can she seriously state 8 months period to avoid listing a hearing?

    Hi LUCIEWARDS

Is it that she is expecting? Medical grounds?

She can put down what she likes, it doesn't mean that the Court will entertain it. The Court will assess whether it's a good enough reason, so they will make the final decision.
