  • CCJ for private parking fine

    I recently received a CCJ from a Gladstones Solicitors to the tune of £290. Long story short, my wife parked the car at a fast food place last year and parked in a delivery driver bay to go and get food. A parking parking charge notice came through the post but they spelt my surname wrong. So me being me, I ignored it and every letter since. (It’s illegal to open somebody else’s mail after all! )Fast forward 12 months and a CCJ drops in my credit report but under the incorrectly spelt surname but on my actual record. How can that be? I’ve rang the court and credit agencies and seem to be going in circles… what rights do I have if any, and should I continue to ignore the CCJ. Would it ever escalate to a high court writ by them escalating costs above the £600 mark? Should I be worried?

      As MIKE770 says you could apply to the court to have the case set aside but then they would just reissue in the correct name, possibly claiming their wasted court fee from the first attempt which means you would then have to defend their action.

      Do you have any prospect of winning and if you lose is the fight worth the additional costs to you?

      Any CCJ can be promoted to a high court writ at any time. Costs never go down, only up.

        Applying for a set aside might be problematic. Why did you not respond to the claim? Because I ignored it m'lud

        To go to the high court the amount has to be greater than £600
