Help. I seem to be pulling my hair out in trying to find out how to amend my defence. I lodged an initial brief defence because I had not received a copy of the credit agreement. The case was stayed for 7 months and then the Claimants legal representatives sent the agreement to me but I did not respond to them so they have now lodged a case to the court to have the stay removed. The agreement that was sent to me is unenforceable. The Claimant solicitors want the judge to make a decision without a hearing. The case is currently on hold because I lodged a complaint about the original credit agreement(valid complaint). However, Im not sure how I can lodge a further defence about the agreement being unenforceable. I have a complete file of documentation that I need to lodge (I have completed the defence form again N9?). Do I just take the documentation into the court?
