          Follow the instructions in post 10. also contact the FOS, explain that you have an active complaint with them, yet the creditor has made a Court claim against you. You need to get on top of this.

            The FOS have done me a letter for the courts and also emailed then solicitors advising them that this is still an going investigation. The solicitors told me at the start of all this that they couldn't do anything whilst the FOS has an active case so i don't know what has changed. Plus the fact that the consent order hadn't happened even though I paid for it

              Post 10 because they have lodge a Court Claim and post 19 because the FOS has given you a letter, send their solicitors a copy.

                Bewary FOS may be investigating but end result courts gave a date limit for FOS report when not arrived case lost, eventually FOS stated as a court case then judge makes decision we will not?

                  I am having the exact same experience with them, I am now on my second FOS Complaint since August 2020 and they have just sent a default notice, 3 payment holidays they are refusing to acknowledge and mysteriously they cannot trace the call that evidences that conversation - even after the FOS advised in their ruling as they provided no evidence to support a non-payment holiday arrangement. I have reported Moneybarn to the FCA as they have clearly not amended their ways after being fined £33 million in 2017 for unfair and poor treatment of customers.
                  I want to see them in court for all that they have done to me but i don't know where to turn as the FOS seem in no rush considering the default expires 30th May and I know they will terminate the agreement and I commute 37 miles a day for work and without my car I have no Job as its a requirement of my job.
