  • Can I issue aCounter claim re substandard? work and photos

    Hello all! Thanks for allowing me to join.
    I would love some advice on defence/counterclaim against a builder who didn’t finish the job.
    The builder is claiming for full payment for works which he left unfinished, he has already doorstepped me with a college in tow and filmed me on his phone whilst demanding that I agree the build is complete (which I didn’t) and that I owed him “over £10k” (which I also didn’t agree).
    He has posted numerous photos of my home on his business Instagram without asking and hasn’t responded to my request to remove them.
    He has done a poor job of work, I called building control part way through as he wasn’t responding to my concerns and the officer emailed him with several issues to remedy.
    His claim doesn’t mention any of that of course.
    so, I absolutely want to defend the claim. I feel the money he has already been paid more than covers the work he actually did. My question is can I counter claim for poor workmanship, the use of the photos, the huge overrun on the build, and my time and stress (I know that’s overused but he knows I’m recovering from cancer and long covid)?

    Has the builder issued a letter of claim?
    Did that letter of claim comply with the protocol?
    Has a claim been issued by the court?
    If yes, have you responded to the court issued claim?

      Have you got that report from building control? That would help your case. Do you have any estimates on what it would cost to correct? That would be your counterclaim.
