    Hi I have been trying to find the previous thread I started referring to my husbands ccj which was obtained by default by lowell financial after they sent the court claim to our old adress back in 2016. We knew nothing about this until a few weeks ago when he received a warrant of notice of control. Since then we have followed the advice given by celestine and submitted an n244 form to the court. Since then lowell sent a letter requesting proof of were we were living in Jan 2016 so we sent them a copy of our tenancy agreement which proves we were not living at the address to which they sent the claim form. We have now had a response from the court saying the hearing will be held by conference call using btmeet. Tomorrow I am also sending the court a copy of our tenancy agreement as evidence that we were not living at the address that lowell sent the claim form to. Do you think that it will still be necessary to have a hearing were we all attend when I am giving the judge proof that we were not at that address. As I have said before I am really poorly and all this is making me ill. Stress of any kind makes my illness worse. I am just so worried and I don't know why because we are genuine people and we are telling the truth and can prove it. It just makes me so angry these people can get away with putting us through all this 5 years after they got a ccj . Even the bailiff came and I had to explain to him what was happening he didn't believe us at first but he did eventually and now agreed to back off. I just want it all over with. . Can anyone tell me what happens during a telephone hearing and what my husband will be expected to say? Just so I know for my peace of mind. Thank you again you have helped us so so much so far.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
