  • Ongoing Set Aside CCJ - Please read & help :) Very grateful

    Hi all,

    Thank you for reading!

On 18th March 2021 I received my monthly credit report and discovered a CCJ dated 17th February 2021 - Stinger considering the 1 month rule.

These are for 4 PCN's dated Nov/December 2018. I subsequently moved address in October 2019, redirected mail for 6 months but stupidly did not update my DVLA or V5C logbook until now.

I do not recollect receiving the tickets and definitely did not receive any follow-up postal/call/texts from the claimant, nor did I receive court documents.

I realise my defence isn't strong as I can't prove that I never received post however, I did pay a PCN in November 2020 to the same company.

My question is: I expect I gave them my new address as my billing address for the payment. Would this be enough to show that they should have used my new address for communication/providing the court in preparation for the CCJ?

    Thanks again!
    Elliott
