Hi guys.
long story short I entered into an Iva four years ago. Just recently checking my credit file I noticed there was a ccj on there from Cabot finance. It was entered incorrectly as they were included on my Iva. I have spoken to Mortimer Clarke who have agreed to get it taken off. This has been going on for over a month now me ringing the courts then back to Mortimer. Basically Mortimer saying they have sent the courts the forms and a copy to me. The courts haven’t revived anything yet. However this morning I received a copy of what they have sent to the court and it’s a letter of discontinuance. Which I’m guessing is wrong. So again I rang the court who have said it needs to be set aside which is what I thought. Rang Mortimer again and they said they had contacted the court again yesterday as they hadn’t heard anything from the court. But they would email me what they had sent and again email is only discontinuance letter. What do I do. I’m going round in circles. They are useless.

Why has it taken you four years to check your credit file?

I assume Mortimer Clarke manage your IVA?

EnglandPi no Mortimer Clarke don’t manage my Iva. I haven’t checked my credit file for four years as I haven’t had credit due to being on an Iva I didn’t feel the need to. But when I did found Mortimer Clarke have issued me with a ccj.
I would like to know what I can do now.
I have had a letter from Mortimer Clarke showing they have sent a form for discontinuance. Surely it should be a form to set the judgment aside. Or am I wrong ?? I would like help as to what I should do now. Write to them ? Or just let them get on with it ?? Thank you for your response by the way.

MIKE770 sorru I don’t understand your reply. The ccj has been awarded. So am I wrong in thinking u can’t discontinue a ccj if it been granted. I thought it had to be set aside.

Correct, they need to set aside the judgment. How can they discontinue a claim that's already been concluded?!
I am aware that companies like Mortimer are still struggling with Covid staffing problems so it's likely connected to that. I will PM you a contact person to reach out to at MC to resolve this directly.
