  • Letter from solicitors stating bailiffs will turn up/CPR Part 8

    Hello,
2 years ago a person fell and grazed his knee at my partners business. he refused any assistance from an independent on site first Aider specifically there for visitors and potential accidents. Nothing ever was heard of the matter until today.
Received a letter stating an application to CCMCC had been made and submitted for a proposed order for the following
    CPR31.16
the business name to provide in 7 days
    heath and safety risk assessment
    maintenance records
    risk assesments
any corrispondance in relation to the incudents
    locus reports

costs to be passed on to defendants.

The letter from the solicitors stated my partner should respond or bailiffs will attend her property. no signed or stamped court papers. no name of the defendant. nothing from the court. no indication of any amount of inancial claim.

No ref number to contact court. is this a scam. little read under CPR PART 8 about defendant must accept acknowledgement. Never emailed us before. apparently evidence of calling a landline number that has been closed for 4 years. old BTline.

Little bit of guidance much appreciated.

Whilst they may have some mileage in what they are trying to do they are a long way short of being able to do much at present. For instance Bailiffs will only turn up if they have gone to Court, won their case & no payment received. I assume the incident was entered into the Accident Book?

Have you checked to make sure they are bona fide solicitors - if so who?

      Dear Ploddertom,
The apparent claim they have made has no reference to a claim for money at all. Just information. We responded to their email yesterday stating we had never heard from them. Their response this morning was they wrote to us on the 02/01/2019. The alleged incident took place on 26th August 2019.
So I am just wondering why the court papers sent to us by them have no stamp/date or reference number. also why the refer to a bailiff visit. They are called Ellis Hass & Co.
      Thank you.
