  • What do after n322a issued

    The ombudsman services ruled that our installer needs us back a sum of money due incorrect installation of a
    boiler. This hasn't happened and the money is out standing.
    We have used a n322a to enforce the award. The paperwork for that has just arrived back from the county court, order for recovery of award. What do we do now? Wait 14 days then instruct the bailiffs?
    Any help will be greatly appreciated.

    Depends on how much it is for - if more than £600 then think about using a HCEO - more effective than the County Court Bailiff. Does the other side have any assets - there is no guarantee you will recoup your money if they have nothing.

      Thank you for your reply.
      He has assets and it is more than £600 its for 9k

      The consumer body said they would pay up from compensation fund if he doesn’t pay but we need enforce the order through the courts first.

        You don't need to wait to enforce as unfortunately whoever you choose has to send a Notice of Enforcement first - roughly takes 14 days for them to comply. Have a look through the FAQs at https://thesheriffsoffice.com/faqs ring them on Monday for a chat and take it from there.

              By all means take your time exploring their site and other similar companies, you can glean a lot of knowledge. I only mentioned the SO as have used them in the past with success against a multi national company who were adamant they would not pay - what a surprise they got when they turned on the doorstep.
