  • Sending documents to court in these uncertain times

    I have a small claims case through MCOL and I've just sent off my directions questionnaire. I sent it by post but now feeling a bit uneasy about it being received and processed. Am I OK to also send it by email or is that likely to cause more problems? In future I think I'll just send documents by email...

    could do both at least Royal Mail get Recorded delivery, keep copy?

      Thanks Mike. I've already sent via post but not recorded delivery which might be part of my worry. I do have a scanned copy of the form as I also sent it to the defendant by email. Might sent via email to the court too then at least I've have confirmation that has sent before the deadline even if it's going to take longer to process. I was just wondering if that would cause confusion or problems if they try to process the DQ twice.

        You should only use one method for sending it in but given current circumstances you should probably send by email as you get an automatic acknowledgement. If I recall the email is ccbcaq@justice.gov.uk

        In the subject line, you should set it out like this: <Claimant> v <Defendant> (Claim no. XXXX)

        In the email body, you can send a short sentence explaining that you have attached the DQ.

          Thanks Rob - as I've already sent by post do you think I should leave it at that?

          I have a few claims going on and I agree for future documentation I'm just going to do everything by email.

            Perhaps on this occasion send it by email so you can evidence just in case.

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
