  • Small claims court during COVID-19

    Hi, I'm the Claimant in a small claims case, issued through money claim online in the County Court Business Centre.*

    From the updates I've seen, I don't think this work is going ahead at the moment? I haven't been contacted to ask if I think the case is urgent.*

    I'm just wondering what happens now. The Defendant filed an acknowledgement of service saying they would defend in full. The defense is due next week (28 days).*

    I'm expecting this date will pass and I won't receive anything. If this happens what do I do? I assume I can't request judgement so do I just wait?*

    Any thoughts would be great. Many thanks.*

    The justice wheels will still keep turning wherever possible, so unless otherwise ordered by the court, the parties should continue with the timeline given and I can't see any reason why the defendant can't file a defence with the court unless there are good reasons why i.e. they have been isolating due to COVID-19.

    The main issue will be when you are at the hearing stage, I had a hearing next week but it has been vacated and expecting something in the post which will probably mean either re-arranging to a date some time in the future, or having a telephone hearing if the court can accommodate.

    All courts are closed to the public pretty much, but I think there are skeleton staff in some courts still processing admin.

    You could give it a week after deadline and call the court asking to see if the defendant has filed a defence, they should be able to get a copy to you over email if you ask.

          I Was due to attend County court on the 15th April, I received a letter today saying the hearing is vacated until further notice.

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)
