  • Appeal Process

    Hello, could anyone help with the correct process for appealing a small claims judgement?
    *I've applied for the transcript of the hearing and I've started completing for N164. It asks for the points that are to be appealed, however I don't have the wording for this until I receive the transcript. Should I request more time to appeal until I have the transcript, and if so what is the process for this?
    I also need to ask for permission as it's not mentioned in the judgement which I'm going to do on the N164 form.

      I appreciate the transcript can be costly, however I need it to clarify some points for the appeal as there are several contradictions between what was said in the hearing and then at the judgement (this was at a later date).

        Did you ask at the time for Leave to Appeal? Believe you only get 3 weeks to do so.

          No not at the time. The N164 form has a section for asking permission to appeal which I’ve completed.*
