  • Defendant wants to reinstate his claim and appeal my counterclaim win..

    Hi my old commercial andlord recently took me to court. His claim was struck out once then reinstated. Got to court and struck out again due to not submitting documents and also having little proof. I then won my counterclaim. Hes due to pay me and we are awaiting court order.. hes now emailed his same old waffle telling me I owe him money and he will take it off what he owes me or will get claim reinstated for 3rd time* can he actually do this?? Its exhasperating!!* Many thanks !

    if its over £600 send the sheriffs in, he cant dispute a high court writ

      Thank you yes its £1400 but hes sent me a long email today about how he intends to appeal my counterclaim win and reinstate his claim or I can except £150 from him and call it quits....urrrr..lol

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
