  • Claim Forrm Lowell solicitors

    Hello I am new to this site so my apologies if I am in the wrong place. Last month I received a letter from Lowell solicitors demanding I paid them for debts from talktalk and shop direct. I replied to this letter with a ‘prove it letter' and they responded by sending me bill summaries of the defaulted accounts. The talktalk breakdown looked as though I could of done it myself on a computer and the shop direct breakdown showed that my last payment was made in May 2013 since then I've had no further correspondence with shop direct which I believe makes this debt older than 6 years and statue barred? I have now received a claim form from Lowell solicitors and now I am at a loss as to where I go from here? Will they take me to court or are they scare mongering? Any advice anyone can offer would be gratefully received. Thank you

    they will try BUT statute of limitations should come into effect once 6 years past England or 5 years Scotland

      Thank you. So if they still try can they still take it to court? I'd hate to have a CCJ against me. I can write back to them stating that the debt is statute barred but that would be admitting that the debt is mine wouldn't it? I'm confused at to what my next step would be as leaving it and waiting is stressing me out

        if they issued one then if so statute of ;imitation would knock out any claim , they do try and push to the last moments before a court hearing then they discontinue, many a person panic and pay them unnecessarily, that is the state od judiciary in this country a law for one and a law for another. abuses of system pushed to limit and get away with it
