  • MCOL issued for parking tickets from Dean Clough- advice on defence please

    Hi,
    Recently received an MCOL claim for alleged 'unlawfully parking on land owned by claimant' for four times. I have sent the AOS, claim was issued on the 21/10/19. I've also made a SAR, which I've received.

    I've noted they have only made two out of four requests for the Keeper details. I believe this is a breach of the KADOE contract and was going to use this to form the basis for my defence. I also considered writing to the company to persuade them to drop the case due to this, in an effort to resolve out of court.
    This is their second attempt as previously, in the PoC they made a typo on my VRN and discontinued the original case (which made me chuckle).

    It's not a breach of KADOE, it merely means that they cannot use POFA to hold the keeper liable for two of the events. POFA 11 (1)

    I presume you made application to the DVLA for the details and you should be able to work out which is which.

      Thats good, because I paid for parking on 2 occasions I wrote to them and they cancelled 2 of the tickets.
