  • Urgent!!! Adducing new evidence

    HI, I’m new here so any help would be appreciated. I have a four day trial I’m the claimant 70k fraud case based on my ex partner deceiving me. Anyway a week before the trial my good for nothing solicitors asked for a further 27.5k for the barrister and £16k for them, when I’ve already paid them £30k. The costs weren’t notified to me beforehand and I had given them £10k on account. Anyway problem is now I’ve sacked them but they haven’t sent in disclosure a year a go documents that I sent them that were vital to the case. Proving the defendants witness statement is a bunch of lies and his witnesses are committing perjury. His lawyers are resisting addicting of new evidence and I believe my only way is to male an application to the court? With the trial so near and over 17 documents that are pages and pages that they left out, I don’t know what to do? Any ideas???

    The lawyers are probably justified in resisting, i think i would otherwise one could argue that you were not acting in your clients best interest.

    It seems to me you will need to make an application, the costs should have been notified, or at least you should have been told a barrister would be needed and the costs of such would be discussed with you at the appropriate time.
