  • Payment made after a Court Claim for a parking ticket

A court claim was received and within 14 days, payment was made to the claimant in full via a Postal Order which was sent via Royal mail tracked delivery and confirmed as signed for by the claimants registered address.

Over a month later, a Default court judgment was received stating that payment had not been made to the claimant. The claimant has failed to inform the court that payment was sent and received via postal order at the company's registered address. Having spoken to the court, they have stated that the defendant must speak to the claimant directly as they must contact the court to confirm payment has been made. However, after numerous attempts to contact the claimant it has not been possible to speak them and they have still not provided confirmation.

Can anyone provide any advice on how to proceed.

I think you will have to apply for set aside (cost £255) and request costs from the parking company.

This response will bump your thread, and hopefully someone more knowledgeable will pick it up
