    Hi all,

    Cabot filed a claim against me in November 2017. With some most appreciated help from members I put together a good defence that was received on 18/12/2017.

    I haven’t heard anything since then and I know that the claim was ‘stayed’ shortly after I submitted a defence.

    I’m asking advice for whether I can get this claim struck out or are sleeping lions best left?

    Im confident that Cabot were chancing the claim for a (CC account) and they realised it wasn’t going to be an easy case and moved on.... I just have lingering concerns they may leave this open indefinitely and have another go at a later date when my eye is off the ball.

    Particularly as I’ve read opinions on here that leaving a claim ‘stayed’ gives Cabot more time to ‘come up with’ the requested documents etc. I’ve also read that some people are having stays lifted many years down the line.

    I guess my question is really how do I finally put this claim to bed before Cabot have another go?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
