  • Warrant/Final Notice

My partner has received number of letters which were ignored partly because of her mental issues, partly because she did not recognise the name Arrow Global Limited.

I live together with my partner for almost 19 years. At the present my earnings are slightly bellow £20,000 a Year and she is making £3,400 a Year as a self employed Ebay trader, at the same time we are mature students.

She is on antidepressants for over 18 months, but first time she was offered this kind of medication was in 2003.

The paperwork sent by Arrow Global Limited and Bailiffs suggest that Court Case took place at the time we were living in Rochdale. We have moved out from Rochdale in October 2015 and until then no correspondence regarding the case was received.

My partner was not able to work full time due to some health issues culminating in serious operation in September 2013. Earlier on in June 2013 my earnings were lowered by £3000 PA due to restructuring in Guinness Partnership who was my employer for over 10 Years.
At that time we were unable to pay our debts already, and I decided to go for an IVA, but without including my partners debts since I was assuming they were not significant. In July 2015 I was dismissed from work and situation become rather dramatic and in October we moved back to London.

On Saturday 30/03/19 I have opened a letter addressed to my other half (she is away - with her mother at the moment) and for the first time it was with HM Courts and Tribunals Service logo.
It is a final notice asking her to pay £4,372.66 or otherwise the Warrant will be escalated to the County Court Bailiffs.

My partner has never entered into an agreement or contract with the Arrow Global Limited.

The sum claimed is higher than all of our personal possessions, so even if we would allow bailiffs to enter our flat, that debt would persist.

I just wonder what are our options now.

When does the alleged debt date from?
When was the last time a payment was made towards it?
    Who owned the original debt?
What is the actual date of the CCJ? Who is the Claimant? How much was the Judgment for?

You might be elegible for court fee remission.

Use Form EX160 to apply for help with fees from a court or tribunal hearing. You may not have to pay a fee, or you may get some money off. Includes EX160A and EX160C.

What other debts does she have? If she may have been ignoring them, could you help her check her credit records to see what shows on
        there.

Presumably you two are renting? Does she own a car?

What happened to your debts - did the IVA go ahead? fail?

The paperwork received recently did not show any details of the debt apart from case number, warrant number, information about previous address, names of claimant and defendant. The name of the claimant is Arrow Global Limited who as far as I understand have purchased her debt.
          The sum is £4,373.
It is connected with previous address it has to be pre 2015. The only option would be that it was Asda Credit card, for which she was unable to pay back in 2013. Her assumption was that the sum owned was lower. We were not aware of the Judgment.

We live in a shared ownership flat (25%). We have no car. The last one I had to sell in 2013 when I could not afford the costs of insurance. My IVA lasted for 3 years (with couple of short breaks) and then failed.
I am a bit scared to look into credit records, but I will do it .
