  • Urgent help please - should I accept mediation

    I put a defence in that my debt was statute time barred. I've now received papers from the court stating that the case is suitable for mediation. Should I accept this or not if my defence is that the case shouldn't proceed? Confused!

    So just to confirm the date of your last payment was more than 6 years or 12 years ago?

    If it is definitely statute barred then mediation will not unbar it and make it enforceable again. You could agree to mediate as this will not affect the fact if it is statute barred, they cannot continue to chase you for the debt.
