  • Small Claims help ?

    Hi I won't make this question too long but someone owes me money and he has been very very difficult in paying it back so I finally decided to take action. I contacted citizens advice and did everything they told me too and then I put through my small claims application. I highlighted everything he has done and why I owed back this money. I did it using the new online way to do it and I assume he gets the small claim emailed to him too as I got it when i submitted it online and I had too put both our emails. He then I assume saw this and instantly sent the money into my account -_- However I had to pay £25 just to submit the small claims which he hasn't paid. I know it's a small amount but is there anyway for him to pay this back to me ? It's incredibly irritating he has frustrated me for months and although I have got my money back I do not like that he did not pay the additional £25 too. Is there anyway around this ?

    The only issue is that this fee is refunded at the discretion of the court, only if you won though. So it would not be definite you would receive the money back anyway. Personally, I would take it on the chin, you have got your money back and actually spent the minimum amount to do so.

    You could ask this person to refund the money as he contributed substantially to causing this situation but if he refuses I would just leave it and move on.
