    Hi

    I have an outstanding CCJ which is being dealt with by tm legal services.

    I had previously told them I had health issues and suffered from anxiety which had meant I was currently unemployed and after filling in their income and expenditure form they told me they would have their specialist team deal with my case.

    Since this email conversation I have heard no more from them and this was in December. I have sent emails every week trying to find out what is happening but I don't ever get a response and I have also sent letters in the post again with no response.

    This is really making my anxiety flare up not knowing what is happening and I am petrified I will just get a balliff turn up at my door to take my stuff.

    Is there anything I can do as like I said this is starting to make me really ill with not knowing what is going on.

    Can you say what the original debt was?

    Also do you have other problem debts as well, either ones where you are currently being hassled by debt collectors or ones where things seem to have gone quiet?

    Are you on JSA, ESA or UC? Are you renting?

      Hi

      It was for a loan with 1st stop loans and has about 650 remaining to pay.

      It is the only debt issue I have and I'm on uc and rent

        The idea that bailiffs will seize all your stuff is a bit of a bluff. Unless you have a car or expensive electric gadgets, there's nothing worthwhile for them to take. Most secondhand stuff won't fetch the cost of taking it away. A lot of things, they aren't allowed to take.

          OK so this is the only issue you have. Then sorting out affordable repayments on the CCJ is your only concern. (I asked because if you had half a dozen other problem debts then it would be better to look at form of insolvency and get your self a clean start, But for one £650 CCJ, looking at insolvency would be overkill.)

          The original debt was a consumer credit debt. That is good because you have the option at some point of sending a complaint to the Financial Ombudsman. Who are a LOT better than other ombudsmen that deal with some other sorts of debts eg water or electricity bills.

          Bailiffs in this sort of case can be ignored UNLESS you have a car, not on finance? Do you?

          It's not nice for anyone to deal with bailiffs, and especially if you have anxiety problems, but it is good to be aware of your rights which is that if you do not open the door to them, there is nothing they can do (unless you have a car parked outside...)

          It sounds from what you have said that you may have been passed to a vulnerable customer team. Which is why they aren't being aggressive. I suspect your income & expenditure would have showed you had no money spare to pay to this CCJ.

          You could just stop worrying and wait until you are contacted. But I know that is not a very helpful suggestion to someone with anxiety problems...

          So what I suggest you do is write (or email) TMLS with COMPLAINT as the title.

          Say you have explained your mental health problems (add the dates you did this if you know them) and since then you have asked several times what is happening to your case. Say the lack of a response from them is making you more stressed and anxious.

          Point out that you cannot afford to make any repayments to the CCJ at the moment and that you don't own any assets (NB I am assuming you don't have any savings or premium bonds or anything.)

          Ask thm to confirm in writing that they will stop trying to enforce the CCJ for a period of 6 months, at the end of which you will get in touch again and update them on your health and employment situation.

          If you go to your local Citizens Advice, they may be able to write to TMLS on your behalf saying this.

            Hi

            Thanks for getting back to me again

            No I have no car nor any savings etc I pretty much have nothing other than a telly that's about 6 years old and basic living items.

            I will write a letter of complaint to them in the morning and start the ball rolling on that and hope I get a reply from them.

            ​​​​​​If they were to go for further action would the court notify me or would it just be a case of bailiffs turning up at my door sorry if it is a silly question but I'm not very clued up on this kinda thing.

              Since they have a ccj, they don't need any more to send bailiffs round. However, simply don't let them in, and there's nothing that they can do. They should not send bailiffs if you are vulnerable.
