  • Clinical Negligence Question

    Hi all, can anyone here help please? Index op 2013, disastrous result. Claim issued mid 2015. Claim defended. I have seen many experts both claimant and defence. Directions issued. This is where I lose the trail...... My solicitor will not send me copies of the Directions Questionnaire or the Directions: is this the norm? Surely I should be able to see what both sides are suggesting? Trial set for 2020, it seems to be an awfully long way away. Anyone who can tell me if this, overall, is acceptable? Many thanks in advance.

    Hello all, new user here. Trying to ascertain whether my solicitor should be sending me information relating to my case, thus far they are refusing to do so. TIA

      Can you perhaps elaborate a little on the issues? When you say your solicitor is refusing to give you any details about the case, can you clarify what your solicitor is withholding?

        Hi PT, thanks for responding. I have asked for a copy of the directions questionnaire which they returned to the court. A copy of the defendants' questionnaire if available and a copy of the directions the court issued. I am trying to get an idea of the timetable we are working to, but the solicitor has just said "oh that is lawyers stuff". Many thanks HG

          Well it is to be fair stuff which most clients wouldnt bother about in a month of sundays, however id say that you are most certainly entitled to a copy, as a client and under the GDPR too.Do you have a copy of the practices complaints proceedure? if so then id say ask again for this info and insist you get a copy, your lawyer will of course charge you for sending it on to you, if they dont then you can use the firms complaints procedure as that is an alternative it seems

            Thanks PT, I will ask them again. I am just curious as to why the court date was set for 15 months time, I thought that by looking at the directions I would have at least some idea of what is happening and why so much (more) time is needed. To be honest, I thought their response was rather dismissive.I will give them another go. cheers HG
